“Rule OF Law” Vs “Rule BY Law”

Yes U Aung Tin, Please write about “Rule OF Law” which is the best in every democracy but although shouting like that by most of the dictators, even DASSK was not practising the “Rule OF Law” but “Rule BY Law” that is all the ambigious laws and they used it to RULE OVER THE PEOPLE, e.g. ၁၉၈၂နိုင်ငံသားဥပဒေ . IF really wish to apply on that law DASSK, Myanmar Military Generals, USDPs, Rakhine leaders and MOST or 90% of Myanmar will be landed into trouble. Just look, WA and Ko Kant leaders and Mon Wun Myanmars would be kicked out of Myanmar. Now it is APPLIED only on Rohingyas and Myanmar Muslims.

EVERYONE MUST BE EQUAL or equally treated UNDER THE LAWS including ၁၉၈၂နိုင်ငံသားဥပဒေ . Same standerds of proof made for all. Now IF MUSLIM or religion is Islam…STRICTLY checked. Once Buddhists, NO CHECKING AT ALL but straight away issue the NRCs.

ပြီးခဲ့တဲ့NUCC ဒုတိယညီလာခံကို နောက်ဆုံးရက်ကျမှ NUGက မတက်ရောက်ပဲ ထွက်ခွါသွားရတဲ့ အကြောင်းရင်းတွေထဲမှာ “နိုင်ငံသားဥပဒေကို NUGက ချက်ချင်း မဖျက်ချင်ရခြင်း”ကလည်း ထိပ်တန်းပြသနာတစ်ခုဖြစ်ခဲ့တယ်။

သူတို့က ၂၀၀၈ခြေဥကို လူထုဆန္ဒမခံယူပဲ သူတို့ဖာသာဖျက်ချခဲ့ပေမယ့် မွတ်စလင်ဖိနှိပ်ဖို့ ပြဌာန်းထားတဲ့ ၁၉၈၂နိုင်ငံသားဥပဒေကျတော့ မဖျက်ချင်ပဲ သူတို့ကိုယ်တိုင်က အင်မတန်သဘောကျနေကြလို့ နောင် လူထုဆန္ဒခံယူပြီးမှ ဖျက်မယ်လို့ ပျားရည်နဲ့ဝမ်းချနေတာပါ။

သူတို့ကို အစိုးရဖြစ်အောင်တင်ပေး၊ သူတို့က အစိုးရဖြစ်ပြီးတဲ့အခါမှ လူထုဆန္ဒခံယူပြီး မဘသတွေ၊ မျိုးချစ်တွေ၊ အစွန်းရောက် နိုင်ငံရေးပါတီတွေကို နောက်ကွယ်က မြှောက်ပေးလို့ ဖျက်လို့မရအောင် လုပ်ချင်နေကြတာဖြစ်တယ်။

နိုင်ငံသားဥပဒေဖျက်သိမ်းရေးကို မဟာဗမာလူမျိုးကြီးဝါဒရှိသူတွေ ဦးစီးချုပ်ကိုင်ထားတဲ့ NUGက ဆွေးနွေးဖို့အသာထား၊ ကနေ့တိုင် အစည်းအဝေး အာဂျင်တာထဲမှာတောင် လုံးဝအထည့်မခံဘူးလို့ သိလိုက်ရတဲ့အခါ ဒီလူတွေကို မအံ့ဩမိပါဘူး။

နောက်ပြီး ရိုဟင်ဂျာဆိုင်ရာ မူဝါဒကိုလည်း ရှင်းရှင်းလင်းလင်း မပြဌာန်းချင်ကြဘူး။

ဒီလူတွေကို လူနည်းစုတွေ မယုံကြည်ကြတာကလည်း သဘာဝကျပါတယ်။

NUCCထဲမှာပါတဲ့ GSC အပါအဝင် အဖွဲ့အစည်းတွေမှာ တိုင်းပြည်အကျိုးအတွက် စေတနာထားကြသော်လည်း NUGနဲ့ CRPHတို့ကိုတော့ လူမျိုးရေးအမြင်ကျဉ်း မဟာဗမာဝါဒီတွေက ချုပ်ကိုင်ထားဆဲဖြစ်တယ်။

NUGကို တိုးတက်တဲ့အမြင်ရှိသူများနဲ့ ပြင်ဆင်ဖွဲ့စည်းသင့်ပြီ။

 My THREE grandparents got NRCs, mother’s father passed away in WW2. I remember my mother’s mother NRC started with WMDY. My parents and elder six got NCRs with ABN048…. (WE were in Kalaw and it was under Aung Ban @ that time.) My NRC ended with 93. Father and mum ended with 91 & 92. ALL Race Bamar & Religion Islam. Note PM UN himself was asking or pushing the Myanmar Muslims to call ourselves Bama Muslims. Why my brothers, sister and their children were forced to change their race. Mg Mg told me that the PP officer forced to write a letter apologizing that he WRONGLY registered his daughter as Bama/Myanmar and should be a mixed blooded…put one sub Indian continent race. Harvard Law School, one of the most prestigious institutions of its kind in the world, has posted a verse of the Holy Quraan at the entrance of its faculty library, describing the verse as one of the greatest expressions of justice in history.

Verse 135 of Surah Al Nisa (The Women) has been posted at a wall facing the faculty’s main entrance, dedicated to the best phrases articulating justice:

“O you who have believed, be persistently standing firm in justice, witnesses for God , even if it be against yourselves or parents and relatives. Whether one is rich or poor, God is more worthy of both. So follow not [personal] inclination, lest you not be just. And if you distort [your testimony] or refuse [to give it], then indeed Allah(God) is ever, with what you do, Acquainted”

Any law that uplifts human personality is just. Any law that degrades human personality
is unjust. All segregation statutes are unjust because segregation distorts the soul and
damages the personality. It gives the segregated a false sense of inferiority.

Let us turn to a more concrete example of just and unjust laws. An unjust law is a code
that a majority inflicts on a minority that is not binding on itself. This is difference made
legal. On the other hand a just law is a code that a majority compels a minority to follow
that it is willing to follow itself. This is sameness made legal. Let me give another
explanation. An unjust law is a code inflicted upon a minority which that minority had no
part in enacting or creating because they did not have the unhampered right to vote.
Who can say the legislature of Alabama which set up the segregation laws was
democratically elected? Throughout the state of Alabama all types of convenient
methods are used to prevent Negroes from becoming registered voters and there are
some counties without a single Negro registered to vote despite the fact that the Negro
constitutes a majority of the population. Can any law set up in such a state be
considered democratically structured?

Race, religion, and language are thus by themselves not primary factors which go to the making of a nation but the historic necessity of having to lead common life together that is the pivotal principle of nationality and nationalism.

Every student of social and political science knows very well that such slogans as race, religion, language do not alone constitute nationalism. There are one or more races in almost every country. Nowadays, we have different religions being embraced by members of the same nationality.

What then constitutes nationalism?

The main factor is the:

  1. having to lead together one common life
  2. sharing joys and sorrows,
  3. developing common interests
  4. and one or more common things like racial or linguistic communities,
  5. fostering common traditions of having been and being one which give us a consciousness of oneness and necessity of that oneness.

“I want to address the Indians and Chinese residing in this country. We have no bitterness, no ill will for them, or for that matter for any race and nationality in the world. If they choose to join us, we will welcome them as our own brethren. The welfare of all people of this country irrespective of race or religion has always been the one purpose that I have set out to fulfill. I recognize both the virtues and limitations of pure nationalism, I love its virtues, I don’t allow myself to be blinded by its limitations, though I knew that it is not easy for the great majority of any nation to get over these limitations. In so far as nationalism encourages us to love our people and love others. In so far as nationalism inculcates in us a sense of national and social justice which calls upon us to fight any system that is oppressive or tyrannical both in our country and the world, there I am completely with nationalism.
